Orders and Payment
 
To place an order with frisky frog, you should be aware of the following:
you must be over 18 years of age;
you will need to supply a delivery address in the United Kingdom and note that PO box numbers, hotels or accommodation addresses are not accepted;
orders for delivery outside of the UK will be subject to additional postage charges which should be confirmed via email prior to placing an order;
you must have a valid PayPal account or credit or debit card issued by a bank accepted by us;
as a minimum, you will be required to provide your real name, an email address, a delivery address and payment details;
our products are not suitable for young children under five years of age;
and by placing your order, you are confirming that you have read and accept our terms and conditions.

To place an online order with frisky frog, simply select the product(s) you wish to purchase by clicking on the 'Add To Cart'  button underneath the product description. You can easily change the number of items in your cart whilst viewing the Shopping Cart.

When you have added your first item to the cart a new 'Shopping Cart' window will open on your screen because your frisky frog cart is located on a secure PayPal server. If you wish to look at more things on the frisky frog site, click the 'Continue Shopping' button. The Shopping Cart window will remain open and you can return to it at any time.

When you are ready to complete your order, return to the Shopping Cart window and follow the on screen instructions to pay by credit or debit card or with your PayPal account.

frisky frog accepts payment securely online.

Your account will be charged prior to dispatch of your order.

Under no circumstances should you send your payment card information to frisky frog via email.
We use PayPal to securely process all of our payment transactions. PayPal is a system used worldwide to pay for goods online, securely and quickly. You do not need a PayPal account to use it; you can pay with any debit or credit card. Whilst we welcome payment by PayPal account, we also accept the major credit and debit cards:

 
Delivery

Our standard terms and prices are for dispatch to UK addresses only. Overseas customers should contact us for postage, packing and handling charges prior to placing an order.

In stock standard items ordered Monday to Friday, will be dispatched no later than next workding day by First Class post (next day delivery by Royal Mail is not guaranteed).

Personalised cards are made to order, Monday to Friday, and single personalised cards will be dispatched within 2 working days.

For larger orders of standard or personalised items please contact us for a timescale prior to placing your order.

In stock Send It For Me items ordered online before 11:00 am, Monday to Friday, will be dispatched same day for next working day delivery. (next day delivery by Royal Mail is not guaranteed).

If an item becomes out of stock you will be contacted within 24 hours and advised of an expected dispatch date, if we have one. You will then have the option of amending or cancelling your order.

A standard postage and packing charge of £1.00 will be added to all orders.

Orders with a total value below £25.00 are usually dispatched by Royal Mail First Class Post. We retain a signed and date stamped Certificate of Posting from the Post Office for ALL items.

Orders with a total value of between £25.00 and £39.00 are usually dispatched by Royal Mail Recorded Signed For delivery. In the event that no-one is available to receive a Recorded Signed For item, a card will be left providing the customer with the option to collect or re-arrange delivery.

Orders with a total value exceeding £39.00 are usually dispatched by Royal Mail Special Delivery for next day (Monday to Friday) delivery by 1.00 pm (*exclusions apply - see below) and must be signed for.  In the event that no-one is available to receive a Special Delivery item a card will be left providing the customer with the option to have the item delivered at a later date.

Where an order is placed for delivery to an unconfirmed address (see PayPal for current definition of an unconfirmed address) frisky frog reserves the right to cancel the order at its discretion.

frisky frog cannot be held liable for deliveries not being made as a result of industrial strike action, severe weather such as flooding, or other events outside of our control.
 
frisky frog reserves the right to arrange delivery by alternative method and/or carrier at its discretion.

Returns

We want you to be completely happy with our products and, in the unlikely event that you are not, we will refund any items provided they are returned to us in re-saleable condition, with intact frisky frog tags and/or labels and clean, unmarked gift packaging, within 14 days of receipt. You must first obtain a Returns Authorisation Code.

Please note that personalised items are excluded from the above refund guarantee and will only be accepted for refund if they are faulty.

Please notify us by email to
mail@friskyfrog.co.uk , quoting your name and the order receipt ID (shown on your payment receipt), or Transaction ID (shown on your dispatch confirmation email), if you are returning an item to us. We will supply you with a Returns Authorisation Code and will also request that you enclose a copy of your delivery note with your returned item. This helps frisky frog to process your refund in a timely manner.

When returning goods, we recommend using Special Delivery for any jewellery items and a Recorded delivery service for all other goods. You should in any event obtain a completed Certificate of Posting free of charge from the Post Office and note that frisky frog cannot be held responsible for anything that is lost or damaged in transit on its return to us.  Return delivery costs and arrangements are at the customer's own expense unless goods are deemed faulty or substandard.

Postage and packing charges are not refundable. Where non-faulty goods are returned when the original order qualified for free postage and packing and the total order amount is reduced to less than the free postage threshold, refunds will be given less the £1.00 postage and packing charge.

For hygiene reasons, earrings may not be returned unless faulty.

Any refunds due are usually processed within one working day and will, in any event, be processed within a maximum of 14 days and paid to the account used to pay for the relevant order at the time of purchase. We are not able to process a refund to a different account or payment card at any time.

This does not affect your statutory rights, in relation to faulty or misdescribed goods, details of which can be obtained from Consumer Direct (the Government's consumer advice helpline) or your local Trading Standards Office.


Damages

We package your orders with the utmost care and attention to ensure that they reach their destination in the perfect condition in which we would like them to be received. However, in the unlikely event that a damaged item is delivered, please notify us in writing, quoting your Order Receipt ID or Transaction ID to mail@friskyfrog.co.uk within 24 hours of receipt.  We will advise you on how to return the item to us and will provide you with a Returns Authorisation Code which you must quote when making the return. If the outer packaging of an item is clearly damaged please make a note of this on the paperwork if you are signing to accept a delivery. Please do not dispose of any damaged packaging as we may ask you to return it to us so that we can make a claim against our carrier.

Privacy

At frisky frog we are committed to protecting the privacy of our customers. We will only use the information that we collect about you lawfully, in accordance with the Data Protection Act 1998.

The information that we ask you to provide when you place an order with us enables us to process your order, dispatch your order, and contact you if there is any query regarding your order. You will be asked to supply your real name, email address, delivery address and payment account details.

You do not have to register with frisky frog in order to make a purchase.

When you place an order and/or if you choose to subscribe to our electronic mailing list, we may occasionally contact you with information regarding special offers or new products. You can unsubscribe from the frisky frog mailing list at any time by sending an email with the words 'opt out' in the subject line and your email address as the message to unsubscribe@friskyfrog.co.uk and we will remove your details from our database within 3 working days.


frisky frog does not send random marketing emails to personal email addresses (spam).

frisky frog does not, and will not, sell, trade or rent your personal information to others.
 

We track very basic information regarding how many visitors we have to our site and how many 'hits' our site receives on a daily basis. 

Cookies are used to track items placed in the shopping cart. If you have your Internet Explorer Security Settings on 'high', you may encounter problems shopping on the frisky frog site and you may wish to amend your Security Settings to 'medium'.

frisky frog does not use cookies to track individuals' information and behaviour.

You can check the information that we hold about you by emailing us and if you should discover any inaccuracies we will amend or remove them without delay. In the very unlikely event that we should intend to transfer your information outside the European Economic Area (EEA) we will first obtain your consent.

Security

The security of data is very important to us. We will only retain customer information in accordance with the Data Protection Act 1998 and our own internal security policy.

We use PayPal to securely process all of our payment transactions. PayPal is a system used worldwide to pay for goods online, securely and quickly. You can see that you are on a secure server when you are viewing your shopping cart or during the checkout process by looking for the letters "https" on the left in your browser address bar.

During 2007 and 2008 frisky frog was a registered and assured member of Safebuy, an organisation dedicated to ensuring that online retailers operate in line with the Consumer Code of Practice, approved by the Office of Fair Trading. Membership of Safebuy is not free of charge and we made the decision not to renew our membership because of the subscription costs but our terms of trading and commitment to customer service remain unchanged.

Packaging

All frisky frog jewellery items are presented in a gift box, or a pink satin pouch or a pale pink suedette pouch. The type of box and/or pouch used will vary depending on the jewellery item(s) purchased and what we have available in stock at the time. You can view a selection of the gift boxes used below.

Whilst our first priority is ensuring that orders arrive in pristine condition, we will also use recycled products wherever possible. You may, therefore, find that your package contains a piece of cardboard from a used delivery box to protect it from being bent during transit.

Complaints

Our relationship with our customers is very important to us and we really want you to be happy in all your dealings with us. We aim to respond to all emails within 24 hours, Monday to Friday, whether they are general enquiries or complaints.

At very busy times, such as Valentines Day, Rosh Hashanah, Hanukkah and Christmas, we may not always be able to meet this target and thank you for your patience.

In the event that you do wish to make a complaint, we would ask that you do this in writing to mail@friskyfrog.co.uk giving us as much detail as possible. We will acknowledge all complaints, in writing, within 3 working days. We will inform the complainant of the action we intend to take and provide an estimate of the timescale to achieve a resolution.

Customer feedback is welcome at all times.

Product Information

Cards

All frisky frog greetings cards are handmade and therefore may vary slightly from the photographs published on the website.

Standard greetings cards are portrait style unless otherwise stated and measure approximately 15 cms by 10 cms.

Coloured square greetings cards are portrait style unless otherwise stated and measure approximately 14 cms by 14 cms.

Square white hammer/textured cards are portrait style unless otherwise stated and measure approximately 12 cms by 12 cms.

Unless otherwise agreed or stated in the product description, all cards are sold with a matching envelope, white unless otherwise described, and are packaged in a protective cellophane sleeve.

The cards are blank inside for your own message unless otherwise described or ordered with Print Inside Card or Send It For Me.

Freshwater Pearls

Freshwater pearls can vary enormously in size, shape and colour making our jewellery unique and special. They are also far more affordable than cultured pearls.

Silver

To retain its shine, we recommend that our silver jewellery is gently polished every few weeks using a soft cloth impregnated with silver polish.

Terms and Conditions

These are the terms and conditions of sale ("Conditions") of frisky frog ("we" or "us"). These Conditions will apply to all purchases of goods in the United Kingdom when ordered via our website (www.friskyfrog.co.uk) ("Website"). Please read this document carefully prior to placing your order.

By placing an order you confirm your unconditional acceptance of these Conditions.

Not all items featured on our website and/or in media features and/or advertisements featuring frisky frog products are necessarily available to order at all times. Please consult this Website to confirm whether goods are available via the website.

We may amend these Conditions from time to time. The latest version of these Conditions is available on our Website and these Conditions will apply to all transactions carried out via our Website.

1. Scope
1.1 In these Conditions:
1.1.1 "Customer" means a person acting as a consumer who is purchasing goods outside the course of his or her trade or business;
1.1.2 "you" means the Customer submitting an order for Goods;
1.1.3 "Goods" means the Goods to be supplied under these Conditions;
1.1.4 "Party" means either you or us; "Parties" means you and us;
1.1.5 "Writing" means letter, fax or email.
1.2 The contract for supply of Goods ("Contract") will be formed when we accept your order. Acceptance of an order by us can only be made in Writing save where ordering Goods via the telephone. Once the contract has been formed we will file it in paper copy for our records.
1.3 Orders may only be placed by Customers aged 18 or over.
1.4 These Conditions and any matters referred to on our receipt form the entire understanding between you and us and supersede any prior promises, representations or undertakings.
1.5 Any omission or error in sales literature, or in any advertisement whether in newspapers, magazines, on the internet or otherwise or in any invoice or other document issued by us may be corrected by us without liability.
1.6 By accepting the Contract you are confirming that you are a Customer in the United Kingdom.
1.7 The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded from the Contract so that no third party may claim any rights under this Contract.
1.8 Clause headings are for convenience only and do not affect the interpretation of these Conditions.
1.9 Words in the singular include the plural and vice versa.

The contents of this Website are protected by copyright. You may not reproduce any part of the Website in any form unless we agree in writing in advance, except as necessary to use the Website in accordance with these terms and/or to keep a record of a transaction between you and us.

4. Orders
4.1 Orders via our Website
4.1.1 Orders may be placed via our Website. You will be responsible for paying any costs of connection to our Website.
4.1.2 Whilst we take reasonable care in ensuring that all material contained in our Website is accurate and up-to-date at the time it is posted, we cannot guarantee it. None of the material contained in our Website is to be relied upon as a statement or representation of fact. All images, illustrations and descriptions of the Goods are for information only.
4.1.3 Whilst we endeavour to ensure that our Website is reliable and available at all times, the internet is not an inherently stable medium and errors, omissions, interruptions of service and delays may occur at any time. We do not give warranty for the accuracy, suitability, reliability, completeness, performance, fitness, freedom from viruses or timeliness of the content or services contained in our Website.
4.1.4 We will not be liable for any damages (including without limitation loss of profit or loss of use) arising out of your use or delay or inability to use our Website, its content or any link to another Website arising in contract, tort (including negligence) or otherwise, except in the case of death or personal injury caused by our negligence.
4.1.5 In the event that prolonged inactivity causes your connection to our Website to fail, your selection of Goods may be lost. In such case, you will be required to re-enter your selection.
4.1.6 Prior to submitting any order, you will be given the opportunity to review your selection, check the total price of your order, and amend any aspects you should wish to. All information on our Website is an invitation to buy only and is not an offer or unilateral contract. Your order represents an offer by you to purchase the Goods. We will acknowledge receipt of your order without delay by sending a confirmation email. Please note however that such confirmation email does not constitute acceptance of your order.
4.1.7 The sale will only be binding by us once we have notified you that the order is accepted and the goods have been dispatched by us. This means that if Goods are shown on our Website but are not available or are incorrectly priced or otherwise incorrectly described, we shall not be obliged to sell you such Goods.
4.1.8 In the event that we are unable to dispatch Goods you have ordered we will contact you without delay by email or telephone and offer you a full and immediate refund.

5. Price
5.1 The price of the Goods you order will be shown on the Website before you confirm your order and will be confirmed on the email confirmation that we will send to you. All prices are in pounds sterling.
5.2 If an error is found in the price of the Goods you have ordered, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel we will refund or re-credit you for any sum that has been paid by you or debited from your payment card or PayPal account for the Goods.
5.3 In addition to the price of the Goods you may be required to pay a delivery charge. All delivery charges are clearly stated on the website and displayed in the Shopping Cart prior to commencement of the checkout process.

6. Payment
6.1 You must pay for the Goods prior to their dispatch to you. Payment must be in pounds sterling and can be made from a PayPal account or by credit/debit card.
6.2 Your PayPal account or payment card will be debited at the time your order is placed.
6.3 In the event that the sum due cannot be debited for whatever reason the sale will be cancelled immediately.

7. Delivery
7.1 Once payment has been confirmed the Goods you order will be dispatched during normal business hours to the address you give when placing your order. Please refer to our delivery information page for delivery methods, timescales and charges.
7.2 If there is no person at the address given who is competent to accept delivery of the Goods, you may be left with a card asking you to contact the local Sorting Office to arrange an alternative delivery date or to collect the Goods.
7.3 Goods will not be dispatched unless payment for the Goods has been confirmed in full. Every effort will be made to deliver the Goods as soon as possible after your order has been accepted but any delivery date or time specified by us is a best estimate only and we will not be liable for any loss or damage suffered by you, or a third party, through any reasonable or unavoidable delay in delivery.
7.4 Ownership of the Goods and the risk for damage to the Goods pass to you upon delivery.
7.5 If at the time of delivery the packaging is damaged, you are requested to open the package in the presence of the carrier in order to verify the condition of the Goods. In the event of damage to the Goods you should note the details on the delivery paperwork and contact us within 24 hours.

8. Limitation of liability
8.1 We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the Contract for:
8.1.1 any losses which are not reasonably foreseeable by both Parties when the Contract is formed arising in connection with the supply of Goods and related services or their use by you;
8.1.2 any losses which are not caused by any breach by us;
8.1.3 business or trade losses
8.2 Our entire liability in connection with the Contract will not exceed the purchase price of the Goods in question.
8.3 Nothing in this Contract means that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents or sub-contractors is limited.
8.4 We shall repair or replace at our expense any Goods damaged or lost in transit where delivery has been made by our carrier provided that:
8.4.1 you give us written notification of such damage or loss within 24 hours of the delivery date in the case of damage and within 24 hours of the anticipated delivery date in accordance with the delivery information published on our Website;
8.4.2 if requested to do so, you produce to us any receipt or other documents relating to the Goods in question and, in the case of damage, the original packaging for the Goods.

9. Your right of cancellation
9.1 You have the right to cancel the Contract at any time up to the end of 14 working days after you receive the Goods.
9.2 To exercise your right of cancellation before the Goods have been dispatched to you you must give written notice to us by email to mail@friskyfrog.co.uk.
9.3 If you exercise your right of cancellation after the Goods have been dispatched, you will be responsible for taking reasonable care of the Goods and for returning the Goods to us as soon as possible and at your own expense in their original packaging, complete with any related accessories, unworn and unused. We recommend you use a Special or Recorded delivery service.
9.4 We will process your refund, excluding applicable postage and packing charges, after we have received the returned Goods and at the latest within 14 days for any sum that has been paid by you or debited from your PayPal account or payment card for the Goods.
9.5 No refund will be offered for Goods that are returned by the Customer incomplete, damaged or soiled.
9.6 The right of cancellation does not apply to Personalised Goods.
9.7 This does not affect your statutory rights, in relation to faulty or misdescribed Goods, details of which can be obtained from Consumer Direct (the Government's consumer advice helpline) or your local Trading Standards Office.

10. Intellectual property rights
The 'frisky frog' trade mark as well as all trade marks, whether they are figurative or not, and all other marks, illustrations, images, and logo which appear on our products, accessories and/or packaging, whether registered or not, are and remain the exclusive property of frisky frog. Any reproduction, whether complete or partial, modification or use of these marks, illustrations, images and logo, for whatever reason and in whatever medium, without our express prior agreement, is strictly prohibited, as is any combination or use in conjunction with any other mark, symbol, logo and more generally any distinctive sign intended to form a composite logo.

11. Delay or failure to perform
We shall not be liable to you if we are prevented or delayed in the performance of any of our obligations to you if this is due to any cause beyone our reasonable control including, without limitation: an act of God, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure of our supplier(s); failure by you to supply us with a correct delivery address and post code or notify us of any change of address.

12. Governing law
12.1 The Contract is governed by the laws of England and the English Courts shall have the non-exclusive jurisdiction to resolve any disputes arising out of or under it.
12.2 No waiver by us of any breach of the Contract by you is considered as a waiver of any subsequent breach of the same or any other provision.
